Drunk Driver Can Sue Bar for Serving Him, Court Rules

A patron at a bar has had one too many drinks. He hops on his motorcycle and drives home, and on the way he's involved in an auto accident. The officer suspects the driver may be intoxicated and performs a field sobriety test. His blood alcohol level is above the legal limit, and he's arrested for a DUI.

So, who's at fault? The driver, right? Apparently not.

A New Jersey court this week ruled that the bar is at-fault for negligently continuing to serve the man alcohol when he was clearly intoxicated. The man's blood alcohol level was .196, more than two times the state's legal limit.
